Terms of service.
The short version: the data is public record, compiled with care and provided as it is; it is for buying property, never for judging people; and it stays inside your company.
§ 01The service
Delta Property Data (“Delta”, “we”) compiles county public records into a dashboard of properties whose owner of record has died or whose title is otherwise in question. We read the county Auditor, Treasurer, Probate Court, Clerk of Courts and Recorder, along with published obituaries, and file what we find as one record per parcel.
These terms govern your use of the dashboard, its exports, and anything else we provide under your subscription (together, the “service”).
§ 02Accounts and seats
A subscription belongs to an account, which is your company, and an account has seats. Five seats are included; more can be added for a monthly fee. Each seat is one named person with their own sign-in, and sign-ins are never shared. You are responsible for what happens under your account and for keeping its credentials private.
Delta adds and removes seats at the account owner’s request. Each person accepts these terms for themselves the first time they sign in. Tell us promptly if you believe a sign-in has been compromised.
§ 03Subscription and billing
The service is sold per county. Each county carries a one-time backlog fee, for the leads we hold for that county on the day you subscribe whose owner is matched to their own death record, and a monthly fee for as long as you stay subscribed. Add-ons, such as extra seats, are billed monthly. Current prices are quoted when we set up your account, and they exclude any sales tax, which is added where it applies.
We invoice your company. A county opens once its first invoice, the one carrying the backlog fee, is paid; paying that invoice also accepts these terms on your company’s behalf. If a later invoice goes unpaid, access pauses 14 days after its due date and returns once it is paid.
The monthly fee covers access to the dashboard and constant monitoring of the researched leads in your counties: a weekly check of the county records for new transfers, probate filings, and changes in taxes and liens. It also covers new deceased-owner leads, added at least once a quarter. Court foreclosure filings are not yet part of the weekly check.
Subscriptions renew each month until cancelled. Cancelling takes effect at the end of the period you have paid for; nothing already paid is refunded, including the backlog fee.
§ 04Data license
All data remains the property of Delta Property Data. Your subscription gives your company a license to use it for finding, marketing to, and acquiring properties in your own business.
- Not allowed: reselling, sharing lists outside your company, sharing logins, or using the data to build a competing product.
- Allowed: sharing individual property records with your attorney, title company, or JV partner for a specific deal.
- Not a consumer report: the data may not be used for credit, employment, insurance, or tenant screening decisions.
- Your marketing, your responsibility: you are responsible for following all calling, texting, and mailing laws (TCPA, Do Not Call).
- Not a title opinion: data comes from public records and may contain errors. Verify title before purchasing.
- If you cancel: you keep the data you've already downloaded for your own use. Updates stop, and these terms still apply.
- Violations: any misuse means immediate account termination with no refund.
§ 05Not a consumer report
The service describes properties and the public record around them. It is a research tool for acquiring real estate, not a means of evaluating people.
§ 06Acceptable use
You agree not to:
- resell, republish or redistribute the data, in whole or in part, beyond the deal-by-deal sharing the data license allows;
- scrape, bulk-download or otherwise extract the service beyond its own exports;
- harass, pressure or mislead any owner, heir or family member you contact;
- use the service in breach of any law, including fair housing and telemarketing rules;
- probe, test or circumvent the service’s security or access controls.
Families named in public records are often grieving. We expect every subscriber to approach them with care, and we will close accounts that do not.
§ 07Public records, as they are
Everything in the service comes from public records and published notices, and those sources are sometimes late, incomplete or wrong. We match records carefully and show you the source of every field, but we do not warrant that any record is accurate, complete or current.
Verify anything material, especially title, ownership and death, with the issuing office or a qualified professional before you act on it.
§ 08Your exports
You may export data for your own company’s acquisition work, and share individual property records from it with your attorney, title company or JV partner for a specific deal. Exports remain subject to these terms: they may not be sold, shared outside your company otherwise, or combined into a product offered to others.
§ 09Our work
The underlying records are public, and nobody owns them. What belongs to Delta is the compilation: the way we gather, match, score and present those records, and the software that does it. That is the data the data license covers, and your subscription is a license to use it, not a transfer of any of it.
§ 10Suspension and termination
You may cancel at any time; access ends with the period you have paid for. You keep the data you downloaded before then for your own use, updates stop, and these terms still apply to it. We may suspend or close an account that breaches these terms, fails to pay, or puts the service or other people at risk. An account closed for misuse closes at once and without refund.
§ 11Liability
The service is provided “as is”. To the extent the law allows, Delta is not liable for indirect or consequential losses, or for decisions made on the strength of the data, and our total liability is limited to the fees you paid in the three months before the claim.
§ 12Changes
We may update these terms as the service grows. When we do, we change the “last recorded” date above and, for material changes, tell account owners by email before they take effect and ask each person to accept the new version when they next sign in.
